MD Construction Warranty Information
At MD Construction, we stand behind the quality of our craftsmanship and materials. To ensure transparency and protect both our customers and our business, we offer the following Limited Warranty with clearly defined terms and conditions.
Warranty Coverage
MD Construction LLC warranties all workmanship on the aluminum structure for TWO full years. There is a FIVE year manufacturer warranty for the Aluminum Frame against cracking, chipping, peeling, and/or blistering. MD Construction LLC will warranty cracks in concrete foundations for ONE year. The Hardware and Screen are NOT covered by this warranty. MD Construction LLC warranties Screen Rooms against leaks for a period of TWO years. Under no circumstances will MD Construction LLC warrant for water leaks on existing roofs or overhangs, as it is not unusual for existing leaks to appear after attachment of new aluminum roofs to existing overhangs as these types of leaks are not noticeable beforehand. If the cause of the leak is due to debris in the gutters adjacent to the aluminum roof, MD Construction LLC has the right to void the warranty and impose a $100.00 trip charge. Gutters must be kept clean in order for rainwater to flow to the downspout properly and not overflow onto the roof. Glass Windows/doors, Vinyl Windbreakers/doors, or Acrylic Windbreakers/doors are covered under a FIVE year manufacturer warranty. MD Construction LLC can assist in filing a claim for any issues or problems associated with these items but will not be held responsible for addressing the issues or problems directly as it could void the manufacturer warranty by doing so.
The warranty period shall be from the date of installation or concrete pour and the original warranty period is not extended by any warranty service or replacement; the remaining warranty period continues in effect and applies under the conditions hereof the warranty service or replacement. The warranties are non-transferable.
MD Construction LLC will only warrant work performed by persons designated and compensated by MD Construction LLC. Any repair, refinishing, replacement, or any other work not authorized by MD Construction LLC shall release MD Construction LLC from all liabilities and obligations with respect to the products involved. MD Construction LLC will not warrant pavers or drainage issues caused by paver sealant if pavers are sealed by anyone other than MD Construction LLC or their representatives. MD Construction LLC will not warrant any drainage or grading issues in the yard. MD Construction LLC will not honor any oral agreements between sales representatives and customers unless it is in writing on face of contract/agreement.
If MD Construction LLC elects to replace any products under this warranty, it may substitute products designated by them to be of comparable quality or price range. If MD Construction LLC elects to refinish any products, they may use different coating materials and different methods of applying the same.
NOTICE TO CONTRACTOR: If Owner wants to make a claim under this Limited Warranty, Owner must provide written notice to Contractor either by mail or email. The notice must specify the problem in detail with pictures or videos and be given to Contractor within the Warranty Term. If mailing a claim, it must be post marked within the Warranty Term. Contractor is NOT responsible under this Limited Warranty for problems/claims for which the required notice has not been given. Text messages will NOT be accepted.
ACCESS: Owner will permit Contractor or its agents, employees, and contractors reasonable access to the Property during the following hours to inspect or perform work required under this Limited Warranty: Monday – Saturday, 8:00 a.m. – 6:00 p.m. If Owner does not grant access to MD Construction LLC after being notified of the repair date and estimated time, MD Construction LLC will impose a $100.00 trip charge. Owner will make sure any gates/doors are unlocked and that all furniture, plants, trees, or other landscaping or objects will be moved away from the area needing service PRIOR to Contractor’s arrival. MD Construction will not be responsible for any damage done to any furniture or landscaping that was not removed prior to the warranty service. Owner will be responsible for extra costs due to inability to gain access for warranty inspections or services after reasonable advance notice.





EXCLUSIONS:
Excluded from this Limited Warranty are the following:
a. Any items for which the Contractor is not responsible under the Construction Standards;
b. Bodily or personal injury of any kind;
c. Mental and emotional pain and suffering;
d. Loss or damage to personal property;
e. Loss or damage resulting from Owner’s improper maintenance or improper operation;
f. Loss or damage resulting from Owner’s failure to provide prompt notice to Contractor of a problem;
g. Any defect, damage, or loss resulting from actions or inactions of persons other than Contractor, such as independent contractors retained by Owner;
h. Consequential or incidental damages of any kind or nature;
i. Attorney’s fees, expert’s fees, and expenses of Owner;
j. Loss or damage caused by external forces, such as acts of God, windstorm, fire, explosion, smoke, water, hail, lightning, falling trees, flood, earthquakes, radon or other gases, pollution, toxic substances, civil disturbance, changes in the level of the underground water table that are not reasonably foreseeable at the time of construction, or criminal acts of a third party;
k. Any loss, damage, defect, cost or expense which is caused by an occurrence for which compensation is provided by state legislation, or which is covered by Owner’s insurance;
l. Any loss or damage by insects or vermin;
m. Normal wear and tear, normal deterioration, or normal changes that are the result of characteristics common to all materials used;
n. Loss or damage resulting from Owner’s failure to comply with a manufacturer’s warranty requirements;
o. Defects in landscaping, including sodding, seeding, shrubs, trees, plants, and fences;
p. Loss or damage of any item from defect in workmanship or materials, including without limitation, any cracks, chips, dents, stains, or marks, except to the extent such items are expressly covered by the Construction Standards;
q. Exterior hardware;
r. Loss or damage resulting from abnormal loading on floors by Owner that exceed design loads as mandated by applicable building codes; and
s. Damage or other problems attributable to Contractor following instructions, directions, or rules of Owner including drainage issues.
